Proferly Terms of Service

These Terms of Service ("Terms") govern your use of Proferly (proferly.com), operated by Proferly ("we," "us," "our"). By creating an account or using the platform ("Platform"), you agree to these Terms.

1. What Proferly Is

Proferly is a platform that connects customers who need a service with businesses that provide services. Customers post requests describing what they need; businesses submit private offers; the customer chooses one business to work with.

Proferly is not a party to the agreement between a customer and a business. We facilitate the introduction. The actual service (pricing, scheduling, quality, and completion of the work) is agreed to and carried out directly between the customer and the business, independently of Proferly.

2. Accounts

  • You must be at least 18 years old to use Proferly.
  • You must provide accurate information when creating your account and keep it up to date.
  • You're responsible for keeping your account secure. Let us know at [email protected] if you believe your account has been accessed without your permission.

3. For Customers

  • Posting a request, receiving offers, and choosing a business is always free.
  • You're responsible for the accuracy of the request details you post. Businesses submit offers based on what you've shared.
  • Once a request has received an offer, you can no longer edit it. This keeps things fair to businesses who've already quoted based on your original details.
  • Accepting an offer means you intend to work with that business. Your contact information is shared with the selected business as soon as you accept their offer.
  • The price in an accepted offer is an estimate. The final price may change once the business assesses the job in person. That conversation and any resulting agreement is between you and the business, not Proferly.

4. For Businesses

  • You can send up to 10 offers a month for free. Sending more needs Pro once it opens.
  • Winning a job is free too. There is no fee, ever, for being chosen by a customer.
  • Being chosen by a customer unlocks that customer's contact information for the specific accepted offer. It does not guarantee the customer will proceed with the job, respond, or that the final price will match your offer.
  • You're responsible for the accuracy of your business profile, offers, and any claims about your qualifications, licensing, or insurance. Proferly does not verify these unless explicitly stated otherwise on the Platform.

5. How We May Contact You

If you've provided a contact phone number on your business profile, you agree that the Proferly team may contact you directly by phone in limited situations, for example, if one of your offers has been accepted but you may have missed our email notification about it. This is meant to help make sure you don't miss a real opportunity, not for marketing or unrelated communication.

6. Fees and Pricing Plans

Proferly is free for customers. Businesses can send 10 offers a month for free. Pro costs $5 CAD a month and lets you send unlimited offers. Winning a job through Proferly never carries a fee, and your profile and Proferly Badge stay free. Pro is not available to buy yet. Until it opens, nothing is charged and no offer limit is applied. When Pro opens, we will announce it on the pricing page and in your dashboard, and the 10 offer limit will apply from that day. Pro renews each month until you cancel. You can cancel any time, and Pro stays active until the end of the period you paid for. We do not give refunds for part of a month unless the law requires it. If a payment fails, we may pause Pro after trying again. Your free offers are counted by calendar month in Pacific time. If we change our prices, we will give you at least 30 days notice by email or in your dashboard, and the change will not apply to a period you have already paid for. We will not charge you for anything you did not agree to.

7. Prohibited Conduct

You agree not to:

  • Post fake requests or offers.
  • Use the Platform to harass, spam, or scam other users.
  • Misrepresent your identity, business, or qualifications.
  • Use the Platform for any unlawful purpose.

We may suspend or terminate accounts that violate these Terms.

8. No Guarantee of Outcomes

Proferly does not guarantee that a customer will find a suitable business, that a business will win any offers, or that any completed work will meet a particular standard. We are not responsible for disputes, damages, or losses arising from the actual service performed between a customer and a business. That relationship is between them.

9. Limitation of Liability

To the extent permitted by law, Proferly is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability for any claim relating to the Platform is limited to $100 CAD.

10. Changes to the Platform or These Terms

We may update these Terms or change, add, or remove features of the Platform at any time. We'll post updated Terms on this page with a new "Last updated" date. Continued use of the Platform after changes take effect means you accept the updated Terms.

11. Termination

You may stop using Proferly and close your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms.
